Acceptance of Terms
By accessing and using PhoenixEd services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms apply to all clients, visitors, and users of our services. If you do not agree with any part of these terms, you must not use our services.
Service Agreement
- Binding Agreement: Upon enrollment and payment confirmation, a legally binding service agreement is established between PhoenixEdย and the client.
- Service Commencement: Services will commence only after full payment has been received and all required documentation has been submitted by the client.
- Scope of Services: The services provided are limited to those explicitly outlined in the service agreement and confirmed in writing at the time of enrollment.
- Service Modifications: Any changes to the agreed scope of services must be requested in writing and are subject to approval and potential additional charges.
Client Obligations
Clients are required to fulfill the following obligations to ensure the smooth delivery of services:
- Accurate Information: Clients must provide accurate, complete, and truthful information in all documentation and communications with PhoenixEd.
- Timely Documentation: All required documents, including academic transcripts, identification, financial statements, and application materials, must be submitted within specified deadlines.
- Communication: Clients must maintain regular communication and respond to PhoenixEd inquiries within 48 hours to avoid delays in processing.
- Deadlines: Clients are responsible for adhering to all university application deadlines, visa appointment dates, and other time-sensitive requirements.
- Third-Party Fees: Clients are responsible for all third-party fees, including but not limited to university application fees, visa fees, health insurance, travel costs, and accommodation expenses.
- Legal Compliance: Clients must comply with all applicable laws and regulations of their home country and destination country.
Payment Terms
- Payment Schedule: All fees must be paid in full before the commencement of services unless otherwise agreed upon in writing.
- Payment Methods: PhoenixEd accepts payment via bank transfer, credit/debit card, and other approved payment methods as specified during enrollment.
- Non-Refundable Fees: All payments made to PhoenixEd are non-refundable, non-transferable, and non-adjustable under any circumstances once services have commenced.
- Late Payments: Services may be suspended if payment deadlines are not met. PhoenixEd reserves the right to charge late payment fees at its discretion.
- Currency: All fees are quoted in the agreed currency and are subject to exchange rate fluctuations if payment is made in a different currency.
Services & Fees
- Scope: Details of services are listed on our website. All rates and fees will be shared with you upon confirmation of services and are inclusive of applicable taxes. Payment must be made in full before the commencement of services. The scope of each service is limited to what is confirmed in writing or verbally at the time of enrollment. Any additional assistance beyond the agreed scope will incur extra charges.
- Services Offered:
- Personalised study abroad, visa and financial advisory.
- Application processing, including SOPs, LORs, and essays.
- Visa assistance, scholarships, health insurance, and accommodation support.
- Organisation of student events such as exhibitions and seminars.
- Payments: Fees are non-refundable, non-transferable, and non-adjustable, whether in full or part. All payments are made for a specific service for a particular applicant and cannot be transferred to other services, future cycles, or family members.
Work Schedule
PhoenixEd operates Monday to Saturday, from 9:00 AM to 7:00 PM IST. Weekend availability may vary depending on the application cycle. Appointments must be scheduled at least 48 hours in advance to ensure adequate preparation time.
Client Responsibilities
Clients must ensure timely communication, adhere to deadlines, and manage their personal schedules. PhoenixEd is not liable for missed deadlines due to client inaction.
Refund Policy
All payments made to PhoenixEd are final and non-refundable under any circumstances.
Limitation of Liability
PhoenixEd liability is limited to the amount paid by the client for the services rendered. Any liability arising from deficiencies in services or obligations will not exceed the total fees paid.
- Service Outcomes: PhoenixEd provides advisory and support services but cannot guarantee specific outcomes, including admission to educational institutions or visa approvals.
- Third-Party Actions: PhoenixEd is not responsible for decisions made by universities, visa authorities, or any other third parties.
- Force Majeure: PhoenixEd shall not be held liable for delays or failures in service delivery caused by circumstances beyond its control, including natural disasters, government actions, pandemics, or technical failures.
Cancellation Policy
- Service Cancellation: Clients wishing to cancel their enrollment must notify PhoenixEd in writing at least 48 hours before the 1st scheduled service date. Cancellations received within 48 hours will incur a cancellation fee of 25% of the total fee.
- Transfer of Services: Clients may request to transfer their enrollment to another date or session, subject to availability. A transfer fee of 10% may apply.
- Non-Attendance: No refunds or transfers will be issued for non-attendance or failure to complete the service.
No Guarantee of Admission
PhoenixEd provides education consulting, advisory services, and support for the study abroad journey. However, we do not guarantee admission to any institution and are not liable if a client is unable to secure admission to any specific educational institution.
Intellectual Property Rights
- Ownership: All materials, documents, templates, and content provided by PhoenixEd remain the intellectual property of PhoenixEd.
- Usage Restrictions: Clients may use materials provided by PhoenixEd solely for their personal application purposes and may not reproduce, distribute, or sell any materials without written permission.
- Client Materials: Any materials created collaboratively with the client (such as essays or SOPs) become the property of the client upon completion and full payment.
Confidentiality and Data Protection
- Confidentiality: All materials shared with PhoenixEd will be kept confidential and will not be disclosed without permission.
- Data Usage: Client information will be used solely for the purpose of providing services and will not be shared with third parties except as required for service delivery (e.g., universities, visa authorities).
- Data Security: PhoenixEd implements reasonable security measures to protect client data, but cannot guarantee absolute security against unauthorized access or data breaches.
- Data Retention: Client data will be retained for a period of 5 years after service completion for record-keeping purposes, unless deletion is requested in writing.
Additional Guidelines
To enhance the service experience, it is crucial for all parties to understand, agree, and adhere to certain operating parameters:
- Guidance, Not Creation: Clients must draft and procure materials (e.g., essays, resumes) required for applications. PhoenixEd provides strategic inputs for clients to implement.
- Communication Response Time: PhoenixEd uses email as the primary communication method. We will acknowledge communications promptly and strive to provide detailed responses within 72 business hours.
- Confidentiality: All materials shared with PhoenixEd will be kept confidential and will not be disclosed without permission.
- Collaborative Approach: Clients will be assigned a lead consultant who will be the primary point of contact throughout the service.
- Feedback and Improvements: Upon completion of services, clients may be requested to provide feedback through surveys or testimonials to improve service offerings.
- Technology Requirements: Clients should have regular access to a computer and the internet for effective communication and collaboration.
Dispute Resolution
- Informal Resolution: In the event of any dispute, clients are encouraged to contact PhoenixEd directly to resolve the matter informally.
- Mediation: If informal resolution fails, both parties agree to attempt mediation before pursuing legal action.
- Jurisdiction: Any legal disputes shall be subject to the exclusive jurisdiction of the courts in [Your City/State/Country].
- Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of [Your Country/State].
Termination of Services
- By PhoenixEd: PhoenixEd reserves the right to terminate services if the client breaches these terms, provides false information, engages in abusive behavior, or fails to make required payments.
- By Client: Clients may terminate services in accordance with the Cancellation Policy outlined above.
- Effect of Termination: Upon termination, all outstanding fees become immediately due, and no refunds will be issued for services already rendered.
Amendments to Terms
PhoenixEd reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Clients are responsible for reviewing the terms regularly. Continued use of services after changes constitutes acceptance of the modified terms.
Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms and Conditions, together with any service agreement and enrollment documents, constitute the entire agreement between PhoenixEd and the client and supersede all prior agreements and understandings.
